大田金業讲故事:5亿元银行骗贷案
你肯定听说过大款、大腕儿,你也肯定听说过大胆,但是,从3家银行骗取5亿多元人民币贷款,大胆到这种程度你还真不一定提说过。那么到底是谁这么无视法律,胆大包天呢?
这个人叫卫承伟,他是重庆谊德实业有限公司(以下简称谊德公司)的老板,还另外控制着重庆黛梦日化有限公司和重庆丹芙莱化妆品有限公司,在重庆可算是重量级人物了。这个人还真够“聪慧 ”,什么重复抵押,提供虚假财务报表,伪造工商资料、虚假按揭等手段样样精通,礼尚往来也被他运用到了极致。
他为了从银行方面谋取不正当利益,向某国有大型银行重庆市分行副行长郑保刚行贿30万元,向重庆市国土资源和房屋管理局市场处处长曾强、副处长杨东渝各行行贿20万元,向市公安局经侦总队一支队副支处长马丁行贿23万元,贿金共计93万元。
这些被“糖弹”击中的“公仆”给他开通了骗贷的绿色通道。1997年至2001年,谊德公司先后多次采取虚构贸易背景、重复抵押、提供虚假财务报表、虚假按揭等手段,从位于主城区的3家银行骗取贷款共计人民币3.9548亿元,重庆黛梦日化有限公司和重庆丹芙莱化妆品有限公司也多次到银行骗取贷款1.5645亿元,骗贷总数5亿多元人民币。
谊德公司获得银行贷款后,卫承伟将其中部分贷款用于个人投资的项目,同时将谊德公司投资的部分优质项目转移至卫承伟等个人名下,逃避返还银行资金。
法网恢恢,卫承伟等人的罪行终究还是暴露了。2011年6月29日下午,重庆市五中法院对卫承伟等11人犯合同诈骗一案公开宣判,卫承伟犯合同诈骗罪、单位行贿罪,被判处无期徒刑,剥夺政治权利终身;被害单位谊德公司犯合同诈骗罪,被判处罚金人民币4亿元;其余10名被告人被判处有期徒期或缓刑。
