欧美也缺互信 自贸再陷僵局

欧元区失业率高得吓人可说是人尽皆知，但我们没看过欧盟贸易代表Karel De Gucht拿「反对自由贸易协议就等着继续失业吧」的话语来恐吓反对者。英国金融时报27日报导，De Gucht 27日表示，如果欧盟坚持「跨大西洋贸易及投资伙伴协议(Transatlantic Trade and Investment Partnership；TTIP)」必须剔除「投资人与地主国之间争端解决机制(Investor to State Dispute Settlement；ISDS)」、那整个谈判可能就谈不下去。德国经济部长Sigmar Gabriel本周就质疑是否有必要为外资设立特别仲裁小组。法国贸易部长Nicole Bricq也对此表达疑虑。De Gucht 27日启动为期90天的特别公开咨询、希望藉此说服欧洲民众接受ISDS。企业团体认为，ISDS向来是双边投资条例不可或缺的条款、是保护外资的必要条件。反对ISDS的人士则是担心，跨国企业可能会藉此钻漏洞、规避各国相关法令。美国烟草巨擘Philip Morris International位于香港的分公司藉由澳洲、香港双边投资保障协议提出法律救济，认为澳洲政府要求移除香烟外包装商标的规定损及其权利。美国贸易代表办公室(USTR)透过官方部落格指出，投资保护为的是要避免在缺乏正当的法律程序以及适当补助的情况下，企业遭受歧视、毁约或财产遭没收等不公平待遇。USTR强调，不是所有国家对于企业投资的保障程度跟都美国一样。USTR驳斥所谓「企业获利未达目标就会透过ISDS来控告投资国」的不实说法。
纽约时报引述消息人士谈话报导，Gabriel本月26日写信给De Gucht，向他表达「欧盟、美国协议没有必要增列特别投资保护条款」的立场。法新社报导，角逐欧盟委员会主席宝座的绿党候选人Ska Keller痛批TTIP是秘密协商的产物、未来将会削弱欧盟的社会、政治以及环保权利。
