伦银定盘价设定银行被控诉

在上周五(7月25日)提起的一宗诉讼中，参与设定伦敦银定盘价的三家银行被指控涉嫌操纵价格。这几家银行是德意志银行、加拿大丰业银行和汇丰控股。
华盛顿居民向美国纽约地区法院提起的诉讼，指控上述银行自2007年1月以来操纵实货银市和纽约商品期货交易所期银市场并寻求让这起诉讼成为集体诉讼。
上述三家银行均未对此发表评论。
这三家银行非法操纵贵金属及其衍生品的价格。他们滥用其确定伦敦白银定盘价的权力谋取不当利益，伤害了以伦敦白银定盘价作为基准价格的白银投资者的合法利益。
极端的保密级别是滋生市场操纵的良好环境。在白银现货和期货市场，被告都有通过伦敦白银定盘价来建仓的强烈动机。这帮助他们攫取了巨额非法利润。
这是首例针对伦敦白银定盘价的市场操纵诉讼案。此前，类似指控还涉及伦敦黄金定盘价。
在这起诉讼之前，从3月以来有一系列的诉讼指控设定伦敦市场指标金价的五家银行被涉嫌操纵金价。这些银行是法国兴业银行、德意志银行、巴克莱银行、加拿大丰业银行和汇丰控股。这些银行均否认指控。
而诉讼首次将矛头对准银定盘价，不过银价最近几年波动剧烈，监管与法律当局对于该市场也很关注。在一场为时五年的调查中，美国商品期货交易委员会(CFTC)调查了关于一些全球大型银行扭曲期银价格的指控。
CFTC未发现不法证据，去年9月放弃了调查。一起包含类似指控的耗时较长的反垄断诉讼，上月底被一家联邦上诉法院驳回。
几家银行通过电话会议，每日设定伦敦银定盘价。德意志银行今年4月宣布退出伦敦金银市场定价小组。这也导致德意志银行、汇丰银行、加拿大丰业银行这三家白银定价小组成员仅剩两家，无法完成正常定价过程。
伦敦白银定盘价将于今年8月14日正式退出历史舞台。伦敦白银定盘价起始于1897年。
